He said:“We are ready to proceed and move the application.” Counsel to the 5th and 8th defendants, Abdul Adamu SAN and Mr Faruk Asekome, said they have not been served with the preliminary objection as well as a counter affidavit.
“My lord, we have filed our counter affidavit and one of our witnesses is here before the court all the way from Lagos State,”Adedipe informed the court.
During the hearing concerning the preliminary objection raised by the sixth defendant, the state’s counsel, Mr.
Adeola Adedipe, SAN, informed the court that he was unprepared to proceed.
Also, counsel to Ganduje, his wife and Umar, Offiong Offiong, SAN, informed the court that he had not served the preliminary objection and the plaintiff’s counter affidavit..
