Justice Lifu, in his ruling, declined APC’s request to rely on an earlier judgment from the same court that had questioned the validity of the primary election which brought Ighodalo to the fore.
The earlier judgment, delivered by Justice Inyang Ekwo on July 4, had criticised the exclusion of 378 delegates from PDP’s February 22 primary election.
Moreover, Justice Lifu supported the argument put forth by Kehinde SAN that the earlier judgment being used to press for Ighodalo’s disqualification had already been overturned by the Court of Appeal in Abuja..
